North Carolina State University is in compliance with this requirement.

Explanation
As explained in NC General Statute 116-4, NC State University is a constituent institution of the University of North Carolina.  As such, NC State University’s authority to grant academic degrees is confirmed by state law through the university system.   

Article III of Appendix 1 of The Code of the University of North Carolina confers degree-granting authority on each of sixteen constituent institutions: “Subject to authorization by the Board of Governors of the nature and general content of specific degree programs which may be offered by an institution, each institution shall determine whether an individual student shall be entitled to receipt of a particular degree….”
